Last Spring, a man was struck and killed by a falling tree while sitting in a golf cart on California’s Tahquitz Creek Golf Resort. The estate of the decedent has now commenced litigation.
It appears that windy conditions may have caused the tree to fall. Presumably contemplating an “act of God” defense by the resort, the plaintiff “alleges that course owners should have taken such conditions into account and adequately warned golfers or closed the course altogether.”
