Groundskeeper Death Leads To Lawsuit

A terrible accident occurred two years ago at Clinton Hill Country Club in Swansea, Illinois, when a motorized fertilizer spreader turned over, killing the groundskeeper who was driving the vehicle.

Recently, suit has been brought against the Club on behalf of the deceased, Scott Richards, claiming that the cart had been modified so as to prevent it from traversing grades as steep as those on which Richards was driving it, and that the club had failed to warn him of its limitations. The complaint alleges that death was not instantaneous, but rather involved a slow asphyxiation.

Presumably, the case will involve insurance defense counsel and will involve issues surrounding the applicability and preclusive effect of workers compensation.
